The Texas Legislature defines a DWI as “not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body” or “having an alcohol concentration of 0.08 or more”. (Texas Penal code 49.01). The Houston prosecution only needs to prove one of the above statements for a guilty DWI verdict.

In Houston, law enforcement uses either a breath, blood or urine test to determine someone’s BAC. The accuracy of these tests leaves much to be desired. Problems associated with the breath test include improper use, improper calibration, improper instructions to the user and the fact that the sample is not saved for testing by an independent lab. You do have the right to insist that your sample be saved for verification by an independent testing facility. Tad Nelson will be able to tell you when the government has made a mistake.

  • Completed the more strenuous Instructors certification class for the DWI Detection and Standardized Field Sobriety Testing.
  • Completed the certification class, Drug Evaluation and Classification Training, "The Drug Recognition Expect School" (DRE - is the person called in when it is believed the DWI has been caused by something other than alcohol).
  • Completed the training course as an Evidentiary Breath Alcohol Technician on the Intoxilyzer 5000 (current generation of breath machine in Texas).
  • Completed the training course as an Evidentiary Breath Alcohol Technician on the Intoxilyzer 8000 (next generation machine, already in operation in several states).
